Latest update on the article: As of 22nd August 2017, Triple Talaq has been banned by the Supreme Court which stated that the practice is unconstitutional, illegal and unworthy. A panel of five judges made the decision, striking it down by 3:2 and finding triple talaq as "bad in law." The court has asked the parliament to make a law within 6 months to govern marriage and divorce in the Muslim community.
But do you think that this decision was an easy one to make? And do you know since when was this in the pipeline? Read the following article that was published on 30th April 2017 to get the gist of it.
Talaq! Talaq! Talaq!
It should not get this easy for anyone to wake up and break a relationship; this has been the voice of hundreds of thousands of Muslim women who find themselves vulnerable.
Talaq Kyun? Talaq Kyun? Talaq Kyun?
Not trying to sensationalize this sensitive and very important issue, WittyFeed is just trying to raise a question by giving its Muslim sisters negatively affected by the Triple Talaq rule a voice. A huge Muslim female population opposing Triple Talaq are in favor of the adoption of 'Talaq-e-Sunnah' (Divorce on the basis of Prophet's sayings) and want the rulebook to reject 'Talaq-e-Biddah' (Divorce system that in a way promotes instant divorce).
While the Supreme Court hearing on May 11, 2017, will come up with the best decision for everyone, let's try to understand the issue and see what the Indian politicians, Muslim parties, and PM Modi has to say on this.
According to Talaq-e-Sunnah, giving talaq to wife in anger or rage is unacceptable. There are at least four steps that must decide if a talaq is going to take place or not.
First step: Mutual conversation to settle down (Fa'izu Hunna)
Second step: Physical separation (Wahjuru Hunna)
Third step: Trying to somehow make it work with talks (Wazribu Hunna)
Fourth step: One family member from each family to meet, sit down and try to make peace (arbitration)
Upon failing at a step, another step is taken into consideration and in case no solution comes out after the 4th step, the husband pronounces First Talaq. He then has to wait for wife's iddah (menses) that take three months. During these three months, the husband can pronounce only two Talaqs followed by the third and final one after the 3-month course/period ends.
Fair enough? Now see what Instant Talaq is all about!
Recently, a National-level Netball player had her husband giving her Talaq on WhatsApp only to leave her devastated with the sudden shock.
This arises the question- How fair is it to kill a timeless relationship with typing of a few texts on a phone screen?
After all, it is about the life of 8.5 crore Muslim women.
What do the Muslim bodies have to say on this?
The All India Muslim Personal Law Board sat in Lucknow to discuss the heated matter and the meeting ended up with conclusions that gave us mixed feelings. On one hand, they said that strict actions must be taken against everyone who's found misusing the rule but on the other hand they did not find anything wrong with a divorce (Talaq) over WhatsApp.
It seemed as if there only aim was to gather 2 crore 17 lakh Muslim women favoring Triple Talaq law. While all this was going on, here is PM Modi's response on the issue:
On Saturday, 29th April, PM Modi addressed the issue during Basava Jayanti Celebrations.
If you can remember, this is not the first time when the Indian PM talked about this issue, he also raised it during BJP's executive meet in Bhubaneshwar sometime ago by saying- "I appeal to you not to view the triple talaq issue from a political perspective. Come out and find a solution, and generations will remember you. I am sure enlightened people will also emerge from among Muslims and come forward to end this practice, liberating our Muslim daughters and mothers from the scourge."
This proves that he is serious on the issue but many found his seriousness wrong and we're surely not going to talk about those people in this post. However, we'll definitely talk about the positive takers.
Allowing his thinking on the issue to go public, he said (English translation)- "The BJP is with Muslim women. Those who give talaq without any reason, at their will… They continuously change wives to satisfy their lust… forcing their own wives and children to beg on the road… Nobody will call this right. BJP will work to restore the honour of women who are victims of such practices."

While addressing in UP's Bareilly rally on the same day when PM Modi voiced on this topic, Sadhvi said- ''Those women who have been given talaq must slap the clerics and adopt Hinduism.''
